President Barack Obama recently signed into law a bill that significantly increases the penalties relating to certain violations of the Occupational Safety and Health Act. Labelled as a “catch-up adjustment”, the new law increases the maximum fines associated with OSHA violations by 78%. An adjustment to the fines was last made in 1990.

The Occupational Safety and Health Administration announced on April 7, 2016, that it was levying a huge fine on New Jersey contractor Berlin Builders. The citations and fines relate to multiple projects, the two most recent of which are the Springford Estates development in Limerick Township, Pennsylvania, and the American House project in Perkasie.

A recent Wall Street Journal article highlighted a long standing issue in construction workplace safety circles. The protection of residential contractors – roofing contractors in particular – from falls on the job. While the problem has been relatively quiet in recent years, it is starting to gain more attention as an increase in injuries and deaths from falls correlates with a rise in the new construction housing market.

Shade.” program. The informational effort is designed to warn workers about how heat stress occurs and, better yet, how to recognize the signs and prevent it.

In what could be seen as a far reaching decision, the United States Court of Appeals for the District of Columbia recently held a firm line in enforcing a 6 month statute of limitations for on-site injury record keeping violations under 29 C.F.R. § 657. The decision – a significant one for those in the construction business – was a firm reminder to the Department of Labor about the principals of separation of powers and its limited power to enforce safety at the project.
