On September 27, 2017, the Pennsylvania Superior Court decided that the Bilt-Rite case, which held that an architect could be liable to a contractor for negligent misrepresentation, applies to other professionals as well. The Court therefore reversed a trial court decision in favor of an accountant, stating that: “We find the court applied a too narrow reading to Bilt-Rite in determining that the case only concerns disputes involving an architect/contractor scenario. Rather, we conclude Bilt-Rite can be applied to other factual scenarios where a party is providing professional information that is designed to be relied upon by a third party.” The case may be found at this link: http://www.pacourts.us/assets/opinions/Superior/out/24161563.

The Wage and Hour Division of the U.S. Department of Labor is increasing its efforts to pursue the misclassification of independent contractors under the auspices of Vice President Joe Biden’s Middle Class Task Force. Calling it a serious problem “for affected employees, employers, and to the entire economy”, the efforts are designed to address the improper designation of employees in some other manner.

I recently attended a legislative breakfast hosted by one of the construction related organizations in which I participate. A number of state legislators were present, as was a representative of the District Attorney’s office in Montgomery County. Because the District Attorney is an elected position in Pennsylvania, this has a certain amount of logic to it. That being said, it is something that is not done very often and caught my attention.
